There are “chambers of commercial matters” (Kammer für Handelssachen) as separate divisions of the higher courts of first instance (Landgerichte). Such chambers of commercial matters do only exist in Germany, Austria, France, Belgium and in 4 cantons of Switzerland. The bench of such chambers is composed of a presiding professional judge and two honorary commercial judges (wearing also the black judges gown) recruited from respected members of the business community. Apart from this difference they hear cases under the same rule of procedure as a court of general civil law jurisdiction. Parties may choose to have their dispute tried by a chamber of commercial matters or by a chamber of general jurisdiction; but access to the chamber of commercial matters is commonly requested due to their expertise in commercial practice and their understanding of what is deemed fair and reasonable amongst merchants.
